l\u2019acqu\u00e9reur est redevable de droits de mutation qui sont de 5.09% pour les droits calcul\u00e9s au taux normal et de 0.715% pour les droits calcul\u00e9s au taux r\u00e9duit.<\/p><ul><li>En cas de vente d\u2019immeuble par des non-assujettis, par exemple par des particuliers, ces mutations sont soumises au taux normal.<\/li><li>En cas de vente d\u2019immeuble achev\u00e9 depuis 5 ans au plus, par un assujetti, cette mutation est soumise au taux r\u00e9duit, alors qu\u2019elle sera soumise au taux normal en cas de vente d\u2019un immeuble achev\u00e9 depuis plus de 5 ans<\/li><li>En cas de vente d\u2019un terrain \u00e0 b\u00e2tir, par un assujetti, cette mutation est soumise au taux r\u00e9duit si la vente est impos\u00e9e \u00e0 la TVA sur le prix total, alors qu\u2019elle sera soumise au taux normal en cas d\u2019imposition \u00e0 la TVA sur la marge<\/li><li>En cas de vente d\u2019un terrain autre qu\u2019un terrain \u00e0 b\u00e2tir, ou de terrain comportant une construction impropre \u00e0 son utilisation, cette mutation est soumise au taux En contrepartie, l\u2019entit\u00e9 s\u2019engage \u00e0 construire un immeuble dans les quatre ans \u00e0 compter de la date d\u2019acquisition et l\u2019entit\u00e9 d\u00e9montre le respect de son engagement par le d\u00e9p\u00f4t, dans ce d\u00e9lai de la d\u00e9claration 940-SD, c\u2019est-\u00e0-dire la d\u00e9claration sp\u00e9ciale d\u2019ach\u00e8vement d\u2019un immeuble. Ce r\u00e9gime est applicable autant pour les constructions d\u2019immeubles neufs que pour les r\u00e9novations concourant \u00e0 la production d\u2019un immeuble neuf\u00a0:<\/p><ul><li>\u00ab\u00a0Cette exon\u00e9ration n&#8217;est applicable aux terrains destin\u00e9s \u00e0 la construction de maisons individuelles qu&#8217;\u00e0 concurrence d&#8217;une superficie de 2 500 m\u00e8tres carr\u00e9s par maison, ou de la superficie minimale exig\u00e9e par la r\u00e9glementation sur le permis de construire si elle est sup\u00e9rieure.<\/li><li>Elle profite sans limitation de superficie aux terrains destin\u00e9s \u00e0 la construction d&#8217;immeubles collectifs, \u00e0 condition que les constructions \u00e0 \u00e9difier couvrent, avec leurs cours et jardins, la totalit\u00e9 des terrains acquis.<\/li><li>Pour les terrains destin\u00e9s \u00e0 la construction d&#8217;immeubles non affect\u00e9s \u00e0 l&#8217;habitation pour les trois-quarts au moins de leur superficie totale, elle est applicable dans la limite des surfaces occup\u00e9es par les constructions \u00e0 \u00e9difier et par les d\u00e9pendances n\u00e9cessaires \u00e0 l&#8217;exploitation de ces constructions.\u00a0\u00bb (Art. 1594-0 G, III)<\/li><li>Une prolongation de ce d\u00e9lai de quatre peut \u00eatre demand\u00e9 pour un an, dans le mois qui suit l&#8217;expiration du d\u00e9lai de quatre ans. Dans ce cas, le nouveau professionnel est tenu par le d\u00e9lai de quatre ans qui a d\u00e9but\u00e9 lors de la prise de l&#8217;engagement initial.<\/p><p>L&#8217;engagement de construire peut \u00eatre prolong\u00e9, par demande \u00e9crite (par LRAR), au plus tard dans le mois qui suit l&#8217;expiration du d\u00e9lai imparti pour construire. Cette demande doit pr\u00e9ciser certains \u00e9l\u00e9ments\u00a0 (Les circonstances de l&#8217;engagement initial, les \u00e9l\u00e9ments de fait justifiant que son \u00e9ch\u00e9ance doive \u00eatre repouss\u00e9e, la consistance des travaux envisag\u00e9s&#8230;).<\/p><p>Le professionnel peut \u00e9galement prendre un engagement de revendre en substitution de l&#8217;engagement de construire. Dans ce cas, le rappel des droits de mutation se fera au taux r\u00e9duit (0,715%) et le d\u00e9lai de 5 ans de l\u2019engagement de revendre d\u00e9bute r\u00e9troactivement \u00e0 la date d\u2019acquisition du bien. Dans le cas contraire, il devra acquitter le rappel des droits \u00e9gal \u00e0 la diff\u00e9rence entre les droits au taux applicable (taux r\u00e9duit ou taux normal) et le droit fixe de 125\u20ac,
